These Terms and Condition apply to all orders/agreements between supplier and Consumer, relating to sale/delivery of products.
The platform is owned by Cartridge Recharger, a company who provide toner cartridge refilling and remanufacturing service all over India at present with its registered office at Makarpura GIDC Vadodara – 390010 Gujarat, India. YET WE DON’T HAVE OUR ANOTHER BRANCH ACROSS INDIA, WE OPERATE FROM OUR MAIN OFFICE ONLY.
For the purpose of these Terms & Condition, whatever the context so requires “You”, “User”, “Organization”, “client(s) or “business customer(s)” shall mean any legal person/organization/company/group of companies who has agreed to become a buyer on the platform by providing registration data while registering on the platform as registered user using the mobile or computer system. Cartridge Recharger allows user to surf the platform or making purchases without registering on the platform. The terms “We”, “Us”, “Our” or “Seller” shall mean Cartridge Recharger.
Your use of these platform and services are governed by the following terms and conditions. If you transact on the platform, you shall be subjected to the policies that are applicable to the platform for such transaction. While Browsing, surfing, accessing or your any other activity on this platform or site indicates that you hereby agree all mentioned policies and terms and conditions of us so please read the terms and conditions carefully before proceeding. At the time of purchase, you shall be contracting with the Cartridge Recharger through this platform to use our products or services.
We reserve the right, at our sole discretion, to modify, to change, to add or remove portion of the terms and conditions, at any time without any prior written notice to you. It’s your responsibility to review these terms and condition periodically for updates or changes. Your continued use of the platform following the posting of changes will mean that you agree with the revised or updated or changed terms and conditions.
1. All commercial/contractual terms are offered by and agreed to between you/organization and us. The commercial/contractual terms include without limitation price, payment methods, payment terms, date, period and mode of delivery, warranties related to products and services and after sales services related to products and services. Cartridge Recharger have control and can determine or advise or in any way involve itself in the offering or acceptance of such commercial/contractual terms between you and us.
2. We provide delivery service under this agreement. The delivery boy will be responsible for cartridge delivery ONLY; he/she will not have any technical knowledge related toner cartridges. Placement of order by you on the Platform is an offer to buy the cartridge(s)/product(s) and it shall not be construed as our acceptance of your offer to buy the product(s) ordered. We retain the right to cancel any such order placed by you, at its sole discretion and you shall be intimated of the same way of an email/SMS. Any transaction price paid by you in case of such cancellation to us shall be refunded to you.
3. The Platform is only a platform that can be utilized by Users to reach a larger base to buy Toner cartridge or other product listed on this platform. We are providing a platform in which we are selling Remanufactured Cartridge(s)/New Cartridge(s) and it is agreed that the contract for sale of any of the products or services shall be a strictly bipartite deal between you/business customers and us and facilitate business to business transaction between us and you/business customers.
4. Cartridge Recharger makes representation or Warranty of the product(s)/cartridges or services proposed to be sold or offered to be sold or purchased on the Platform until it gets empty to its desired page yield. Once it gets empty, we do not make any representation or Warranty of the cartridge proposed to be sold or offered to be sold or purchased through this Platform. We accept no liability for any errors or omissions. We assure you quality, safety and on time delivery of the product(s)/cartridge(s) as committed.
5. You/ business customers shall independently agree upon the manner and terms and conditions of delivery, payment, warranty, product etc. with us.
RESTRICTIONS
You/ business customers/client agree, undertake and confirm that your/business customer’s use of Platform shall be strictly governed by the following binding principles:
1. You/business customers/client shall not host, display, upload, modify, publish, transmit, update or share any information which:
(a) Belongs to another person and to which You/ does not have any right to;
(b) Harasses or advocates harassment of another person;
(c) is misleading in any way;
(d) is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, paedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual;
(e) is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, paedophilic, libellous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986;
(g) promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libellous;
(h) infringes upon or violates any third party's rights [including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number) or rights of publicity];
(i) Provides material that exploits people in a sexual, violent or otherwise inappropriate manner or solicits personal information from anyone;
(j) Shall not be false, inaccurate or misleading;
(k) promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices;
(l) provides instructional information about illegal activities such as violating someone's privacy, or providing or creating computer viruses;
(m) contains video, photographs, or images of another person (with a minor or an adult).
(n) Harm minors in any way;
(p) Solicits gambling or engages in any gambling activity which we, in our sole discretion, believe is or could be construed as being illegal;
(q) Interferes with another User's use and enjoyment of the Platform or any other individual's User and enjoyment of similar services;
(s) tries to gain unauthorized access or exceeds the scope of authorized access to the Platform or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Platform or solicits passwords or personal identifying information for commercial or unlawful purposes from other users;
(t) Infringes any patent, trademark, copyright or other proprietary rights or rights of publicity or privacy or shall not be fraudulent;
(u) contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer resource; or other computer programming routines that may damage, detrimentally interfere with, diminish value of, surreptitiously intercept or expropriate any system, data or personal information;
(w) Impersonate another person;
(x) violates any law for the time being in force;
(y) Threatens the unity, integrity, defence, security or sovereignty of India, or public order or causes incitement to the commission of any cognizable offence
(z) shall not, directly or indirectly, offer, attempt to offer, trade or attempt to trade in any item, the dealing of which is prohibited or restricted in any manner under the provisions of any applicable law, rule, regulation or guideline for the time being in force. Removing any copyright, trade mark or other proprietary notices from any portion of the services will be an illegal and punishable offence.
1. We shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of any third party on the Platform.
2. It is possible those other users (including unauthorized users or "hackers") may post or transmit offensive or obscene materials on the Platform and that you may be involuntarily exposed to such offensive and obscene materials. It also is possible for others to obtain personal information about you due to your use of the Platform, and that the recipient may use such information to harass or injure you. We does not approve of such unauthorized uses, but by using the Platform You acknowledge and agree that We are not responsible for the use of any personal information that You publicly disclose or share with others on the Platform. Please carefully select the type of information that you publicly disclose or share with others on the Platform.
3. We have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).
4. You shall not probe, scan or test the vulnerability of the Platform or any network connected to the Platform nor breach the security or authentication measures on the Platform or any network connected to the Platform. You may not reverse look-up, trace or seek to trace any information on any other User of or visitor to Platform, or any other customer, including any account on the Platform not owned by You, to its source, or exploit the Platform or any service or information made available or offered by or through the Platform, in any way where the purpose is to reveal any information, including but not limited to personal identification or information, other than Your/ business customers/clients own information, as provided by the Platform.
5. You shall not attempt to gain unauthorized access to any portion or feature of the Platform, or any other systems or networks connected to the Platform or to any server, computer, network, or to any of the services offered on or through the Platform, by hacking, password "mining" or any other illegitimate means.
6. You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about Us or the brand name or domain name used by Us including the terms of Cartridge Recharger, or otherwise engage in any conduct or action that might tarnish the image or reputation of us on platform or otherwise tarnish or dilute any Cartridge Recharger trade mark, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us. You agree that you will not take any action that imposes an unreasonable or disproportionately large load on our systems or networks, or any systems or networks connected to us.
7. You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Platform or any Content, or in any way reproduce or circumvent the navigational structure or presentation of the Platform or any Content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Platform. We reserve our right to bar any such activity.
8. You agree not to use any device, software or routine to interfere or attempt to interfere with the proper working of the Platform or any transaction being conducted on the Platform, or with any other person's use of the Platform.
9. You/business customers/clients may not use the Platform or any content for any purpose that is unlawful or prohibited by these Terms of Use, or to solicit the performance of any illegal activity or other activity which infringes the rights of Cartridge Recharger.
10. You/business customers/clients shall at all times ensure full compliance with the applicable provisions of the Information Technology Act, 2000 and rules there under as applicable and as amended from time to time and also all applicable Domestic laws, rules and regulations (including the provisions of any applicable Exchange Control Laws or Regulations in Force) and International Laws, Foreign Exchange Laws, Statutes, Ordinances and Regulations (including, but not limited to Sales Tax/VAT, Income Tax, Octroi, Service Tax, Central Excise, Custom Duty, Local Levies) regarding Your/business customers/clients use of Our service and sale of product(s) or service(s).
11. Solely to enable Us to use the information You/business customers/clients supply Us with, so that we are not violating any rights You might have in Your Information, You agree to grant Us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to exercise the copyright, publicity, database rights or any other rights You have in Your Information, in any media now known or not currently known, with respect to Your Information. We will only use your information in accordance with the Terms of Use and Privacy Policy applicable to use of the Platform.
12. Authorized person must be present there to receive the cartridges delivery and in absence of authorized person third person can receive product(s)/cartridge(s) and in this situation if the cartridges get damage/defective/stolen then we are not responsible in such case and no cartridge replacement or monetary refund will be granted under such conditions you and only you will be responsible for such losses.
Cartridge Recharger reserve the right, but have no obligation, to monitor the materials posted on the Platform. We have the right to remove or edit any content that in its sole discretion violates, or is alleged to violate, any applicable law or either the spirit or letter of these Terms of Use. In no event shall we assume or have any responsibility or liability for any Content posted or for any claims, damages or losses resulting from use of Content and/or appearance of Content on the Platform. Any content shall not infringe any proprietary or other rights of third parties or contain any libellous or otherwise unlawful information.
ABOUT NETWORK CHARGE AND DEVICES
Your mobile network data and messaging rates and fees may apply if you access or use these platform/services from a wireless enabled device/computer/laptop and you shall be responsible for such rates and fees. You are responsible for obtaining the data networks access necessary to use the services. You are responsible for acquiring and updating compatible hardware or device necessary to access and use the services and applications and any updates there to. We do not guarantee that the service or any portion other of will function on any particular hardware or devices. In addition, the services may be subjected to malfunctions and delays inherent in the use of the internet and electronic communication.
MESSAGES
By creating an account on Cartridge Recharger application or website, you agree that the platform/services may send you text messages as part of the normal business operation of your site of the services. You consent to receiving such text message and acknowledge that any steps taken by you to not to receive such text messages will affect your use of the service.
ACCOUNTS
No person other than yourself has the right to access your account. You agree and acknowledge that you will not allow any other person to access and use your account that you will not share your login credentials [i.e. your password and user name] with any other persons others. You must be at least 18 years of age to obtain an account, unless a specific service permits otherwise. Account registration requires you to submit to Cartridge Recharger certain personal information such as your name, address, mobile number, email address. If it is reasonably suspected by us that you have shared your credentials or allowed a person other than yourself to access and use your account, your access to the account will be suspended without giving prior notice to you. You hereby expressly acknowledge and agree that you and not we will be responsible for your losses by an unauthorized use of your account. Notwithstanding the foregoing you may be liable for the losses of us or others due to such unauthorized uses.
PRIVACY POLCY
Cartridge Recharger never discloses your personal information/data to any third party. We may provide necessary information to an insurer if there is complain regarding product or when delivery boy is not able to find your exact location or to government body or investigating agency if required by law or in furtherance of any investigation you and a third party and such information is necessary towards the enquiry or investigation that is being carried out by the said body and/or agency as the case may be.
The privacy policy is here by incorporated into the terms and condition set forth herein. Your use of this website or app is governed by this privacy policy. The privacy policy contains information that how user may seek access to and correction of their personal information held by us.
PRODUCT POLICY
1. Time and quality of delivery is very important to us; we want you to be more than satisfied with our services. We assured that our listed Remanufactured/New cartridge are quality tested from our unit by our technical staff and free from all printing defect. If any printing defects arise in your purchased cartridge/s then we will examine it at our unit which may take some days also depending on the situation. Whole process will be carried out as decided by us in terms of use and then at last we will provide a report on the basis of it. Whatever the report will be generated and provided to you must have to except it and act according to our guidelines in that report.
2. In case if the cartridge is defective/damaged, we will provide a replacement against it once our examination get completed and report is submitted about that particular cartridge. In case, if you do not need replacement, we may provide refund to your bank account/wallet within 7 business working days.
3. The warranty period will get completed once the cartridge is empty, then no replacement/refund will be provided to you. If the Empty Cartridge(s) is returned to us in sealed pack condition on the side of screws THEN AND THEN ONLY we will provide cash back of required/displayed percentage to you. If the empty cartridge is unsealed, no cash back will be provided in this condition. Once the product(s)/cartridge(s) handed over to you after delivery and any damage cause because of careless handling, miss handling, fall of cartridge ground/floor or for what so ever reason the product(s)/cartridge(s) damaged or stolen, we are not responsible for such situation and no product(s)/cartridge(s) replacement or monetary replacement will be granted.
4. We will collect your empty cartridge at the time of delivery of repeat purchase of another or same model cartridge from this platform, no special pick up service will be provided for less than 04 Empty Cartridges. If any product delivered, other them which are ordered then replacement will provide. No replacement once the cartridge got empty.
ORDERS AND PAYMENTS
All orders shipped from Cartridge Recharger will be delivered via standard delivery only. The cartridges will be delivered at your door step within given time period only but delivery may get delay in case of uneven condition like strike, communal/religious riots/protest, curfew, due containment zones etc. in your area. The delivery may get delay is case of natural disaster such as very heavy rainfall, flood, cyclone, earthquake or water logged in city etc. or in accidental situation such as short circuit etc. or in case or unavailability of stock in our inventory.
Cartridge will be dispatch, once you will get an order confirmation message from our side. In case of COD (Cash on Delivery) Payment must be kept ready within the time before cartridge reach at your door step to save yours and us time. Bill will be sent to you with the cartridge and also via mail.
You have to make Payment by COD (Cash on Delivery) or online, no credit system is allowed on this platform. No minimum quantity of order is required to place an order. Multiple purchases are allowed through this platform up to 150 quantities. Any requests for refunds, returns, cancellation or any other matters customer must contact us on crhelpme@gmail.com only.
Order can be cancelled up to before a last minute of the delivery; after cartridges get delivered for cancellation of order no refund will be provided. We are not responsible for loss/stolen of cartridges due to incorrect delivery details provided to us. All prices are set inclusive of GST.
DELIVERY POLICY:

The delivery may get delay is case of natural disaster such as very heavy rainfall, flood, cyclone, earthquake or water logged in city etc. or in accidental situation such as short circuit etc. or in case or unavailability of stock in our inventory or for whatever genuine reason, the delivery time shall be extended by days also.
The delivery person will not have any affiliation with the cartridges and have technical knowledge of cartridge which he/she has to deliver. Cartridge will be dispatch, once you will get an order confirmation message from our side. The delivery service will be free of cost in Vadodara district only. For delivery of product(s)/cartridge(s) in different cities other then Vadodara district, we may use courier services and will get it delivered within 24*7 as per our commitment.
In case of wrong address provide by the customer at the time of placing order and we are not responsible for delay of order. Payment procedure for this delivery service will be instant as mentioned in the terms & conditions.
The delivery time period of different location in Vadodara district is different depending on their travel distance from our unit. As we have notified you at the time of registration or sign up or while changing address.
